These Terms of Service (“Terms”) govern your access to and use of the Emission-Eye Oy platform and related services (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms.
1. Use of the Service
The Service provides real-time emissions monitoring, analytics, and compliance support tools for maritime and related industries.
You agree to use the Service only:
In compliance with applicable laws, regulations, and industry standards (including environmental and maritime regulations)
For legitimate business, operational, or research purposes
You are responsible for all activities conducted under your account.
2. Accounts and Access
To access certain features, you may be required to create an account.
You agree to:
Provide accurate and complete information
Maintain the confidentiality of login credentials
Promptly notify us of any unauthorized use
Emission-Eye Oy reserves the right to:
Suspend or terminate accounts
Restrict access
Investigate misuse or suspicious activity
3. Content and Data
You retain full ownership of:
Sensor data
Operational data
Uploaded documents and datasets
By using the Service, you grant Emission-Eye Oy a limited, non-exclusive right to:
Process, store, and analyze data
Generate insights, reports, and predictions
Improve system performance and models
We do not sell your raw data to third parties.
Where applicable, data may be:
Aggregated and anonymized
Used for benchmarking and system improvement
You retain full ownership of all sensor data, operational data, and any documents or datasets uploaded to the Service. By using the Service, you grant Emission-Eye Oy a limited, non-exclusive right to process, store, and analyze such data for the purposes of providing, maintaining, and improving the Service, including generating insights, reports, and predictive analytics. We do not sell your raw data to third parties. Emission-Eye Oy processes personal data in accordance with the General Data Protection Regulation and applicable Finnish data protection laws, ensuring that any processing is based on a valid legal basis such as contract performance or legitimate interest, and follows core principles including data minimization, purpose limitation, security, and storage limitation. Appropriate technical and organizational measures, such as encryption, access control, and secure infrastructure, are implemented to protect data. To the extent personal data is involved, you have the right to access, correct, delete, restrict, or object to processing, as well as request data portability, in accordance with GDPR. In this context, you act as the Data Controller for your data, while Emission-Eye Oy acts as a Data Processor on your behalf, and where required, a separate Data Processing Agreement (DPA) may be established. We may use trusted third-party service providers under strict contractual and GDPR-compliant obligations. Additionally, anonymized and aggregated data may be used for benchmarking, research, and system improvement, provided that such data cannot be used to identify any individual or organization.
4. Acceptable Use
You agree not to:
Use the Service for unlawful, fraudulent, or harmful purposes
Interfere with system integrity, security, or performance
Attempt unauthorized access to infrastructure or data
Reverse engineer, copy, or exploit proprietary technology
5. AI and Analytical Outputs
The Service includes AI-driven analytics (“EYE-Q”) and predictive models.
All outputs:
Are informational and decision-support tools only
May include estimations, assumptions, and model-based predictions
They do not constitute:
Legal advice
Regulatory certification
Financial or operational guarantees
You remain fully responsible for:
Validating outputs
Making operational and compliance decisions
6. Blockchain Verification Layer
Where applicable, emissions data may be:
Cryptographically processed
Anchored to distributed ledger systems (“Verif-EYE”)
While this enhances data integrity and traceability:
It does not replace regulatory approval or certification processes
External authorities retain final compliance authority
7. Availability and Service Changes
We aim to provide reliable and continuous access; however:
The Service is provided on an “as available” basis
Downtime, interruptions, or delays may occur
Emission-Eye Oy may:
Modify features
Update system architecture
Discontinue components
At any time, with or without notice.
8. Termination
You may stop using the Service at any time.
We may suspend or terminate access if:
These Terms are violated
There is misuse, abuse, or security risk
Upon termination:
Access rights cease immediately
Data handling follows applicable agreements and regulations
9. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
Emission-Eye Oy makes no warranties regarding:
Accuracy of data or analytics
Continuous availability
Fitness for a particular purpose
10. Limitation of Liability
To the fullest extent permitted by law, Emission-Eye Oy shall not be liable for:
Indirect or consequential damages
Loss of profits, revenue, or data
Operational or compliance decisions made based on the Service
Total liability, if any, shall be limited to the amount paid for the Service.
11. Changes to These Terms
We may update these Terms periodically.
Continued use of the Service after updates constitutes acceptance of the revised Terms.
12. Changes to These Terms
These Terms shall be governed by the laws of Finland.
Any disputes shall be subject to the jurisdiction of Finnish courts.
